Two Port Richey parents face felony child neglect charges after their 6-month-old daughter was hospitalized with a blood alcohol level of 0.383, according to an arrest affidavit first reported by Fox 13 Tampa Bay.
Jessie Waldroup, 36, and Desirea Uzunboylu, 27, were arrested Sept. 17 and each charged with felony child neglect causing great bodily harm. The Pasco County Sheriff's Office alleges the girl ingested vodka that had been mixed into her bottle while the family was at a beach Sept. 7.
A blood alcohol level above 0.30 can cause fatal alcohol poisoning, according to the Cleveland Clinic. Florida's legal limit for adult drivers is 0.08.
Brother found infant unresponsive after school
A 7-year-old boy came home from school Sept. 8 to find his parents asleep in the living room and his baby sister unresponsive in her playpen, the affidavit says. The boy woke his parents, who called 911. First responders found the baby still breathing.
Emergency crews airlifted her by Bay Flight helicopter to a children's trauma hospital. Medical staff described her condition as critical but stable and said she likely would have died without immediate treatment.
A full nonaccidental trauma evaluation found no internal bleeding, fractures or intracranial abnormalities, court documents show. Doctors did, however, find bruising on her head, thigh and abdomen. The affidavit describes the abdominal bruising as "highly suspicious for non-accidental trauma." Authorities have not released an official cause for the bruising.
Uzunboylu said the abdominal mark was a rash known to the family's pediatrician, but medical records show no prior reports of one.
Parents point to vodka-filled water bottle at beach
Both parents initially told deputies they did not use drugs or alcohol and had no explanation for how alcohol entered their daughter's system. Uzunboylu later told investigators the family had gone to the beach with relatives, where a family member put vodka in a water bottle inside a backpack.
The parents acknowledged they must have used that water bottle to mix the baby's drink, according to the affidavit. Her 7-year-old brother said he saw Waldroup give her a bottle there.
Deputies found the girl's bottle inside the family home and reported it gave off a strong odor of alcohol. Both parents confirmed it was the only one she used. Although they said they kept no alcohol in the home, deputies found wine and a shot of liquor inside the residence.
The Child Protection Team evaluated the 6-month-old and verified findings of both neglect and abuse.
Potential penalties and next steps in court
Bryant Camareno, an attorney not affiliated with the case, told WFLA that if prosecutors prove the parents' guilt beyond a reasonable doubt, "they're facing penalties anywhere from five years, 15 or maybe even 30, depending on the severity of the injuries."
Waldroup and Uzunboylu were released from the Pasco County Jail on bond. Court records show they are barred from contact with their daughter. No attorney for either defendant is listed in public records. As of Sept. 22, neither had entered a plea, and no court dates had been set.
